Preparing for the Bar Exams

The last time I made a post in this blog was in February. After which I became busy with my final examinations, my graduation and right after, my bar review.  I realized I have been in hibernation from activities that do not involve my preparations for the bar examinations. I do not know whether it is good or bad. But one thing is certain, I am trying my very best to give this bar review my best shot.

After 105 days from now, I know I will have all the time in the world to catch up with friends and relatives to make up for the lost time. Just bear with me.

Rest assured I am just around. . . . . .

The Cartoon Personality in You

Recently, I got an email saying that everyone has a personality of a cartoon character.

The email said that a group of investigators got together and analyzed the personalities of well-known and modern cartoon characters and translated the information gathered into this test.

New Year New Hope

Last 29 December 2008, the Social Weather Station (SWS) released the results of its Fourth Quarter Social Weather Survey showing that 92% or nine (9) out of ten (10) adult Filipinos look forward to the year 2009 with hope rather than with fear.

I am not at all surprised with the survey result.

If there is one thing I am proud being a Filipino is that ingrained psyche of endurance, persistence and sense of optimism to face every adversity as they come. Whether the world is in a global crisis or the country is in deep political turmoil, life seemingly goes on normally in this country as if nothing is wrong. A Filipino is always a survivor.

Personally, I am also raising my bar of hope that the coming year would be a better year for me, my family, my loved ones, my friends, my colleagues, and my countrymen, in general, particularly in terms of peace, prosperity, happiness, and health. Of course, hope is not enough. Hope without any positive action would just be a mere broken dream.

I am glad that our calendar system has beginning and an end. I could not imagine what human psychology would be when we all have to live our lives in one continuum from birth to death.

I wish all of you, as I wish myself, all the best in 2009. And let us not forget to thank our Creator for a brand new year.

Give Love this Christmas

It is beyond dispute that Jesus Christ is the most popular, the most remembered, and the greatest man that ever lived in this world. And in a few hours, particularly at the stroke of midnight, families, at least in the Filipino tradition, will gather to partake some food and exchange some gifts to celebrate his birthday, centuries after being born quietly in a manger.  

We all know what Christmas means and it may mean differently for different people. If I am to describe what Christmas means to me in one word, I would say it is “love”. The birth of Christ is all about giving love. We may actually do away with the trappings and symbols of Christmas. But certainly, expressions of love - reunions, gift-giving and hugs and kisses - to celebrate the spirit of the season are something I or we cannot do without.  

The lyrics of tghe old song of Jackson 5 ”Give Love on Christmas Day“ captures my sentinment about Christmas:

“Why don’t you give love on Christmas Day?
The man on the street and the couple upstairs
All need to know there’s someone who cares.
Give love on Christmas Day
No greater gift is there than love.

What the world needs is love
Yes, the world needs more love.”

During the Christmas Party of the Information Technology Center of the Arellano University School of Law last 15 December 2008, I experienced a special feeling of love during the gift-giving activity to the streets children of Pasay City. And that special feeling turned more profound after visiting the SOS Children’s Village in my home province in Banay-Banay, Lipa City, Batangas last 22 December 2008 to handover the gifts contributed by the law classes of Prof. Jimmy Soriano.  I am delighted to know that there are women like the SOS Mothers, who are there to dedicate a good part of their lives for the love of the orphaned, abandoned and neglected children under their care.

Like Jesus Christ, love is universal and springs eternal in the hearts of men. We all need to love and be loved. That’s probably why Jesus lives and would continue to live in our hearts. 

This Christmas, let us not forget to give love to our loved ones and to those who need it. I did.

Women Preferring Internet Over Sex

Two days ago technology giant, Intel Corporation, just announced in a press release the results of an “Internet Reliance in Today’s Economy” survey conducted by Harris Interactive

One of the interesting findings of the Intel-sponsored survey is that nearly half (or approximately 46%) and 30% of the men respondents “would rather go without sex for 2 weeks than give up Internet access for the same amount of time”. For women aged 18-34, it was 49% and for women aged 35-44%. For men aged 18-34, it was 39%.  

The survey was conducted online within the United States from 18-20 November 2008 with 2,199 adults as respondents. The survey is not based on a probability sample.

They say, and I agree, that the Internet has definitely changed the way people do business, interact and communicate. Individual lifestyle has reached a new dimension. Some people would rather forego important personal acitivites or chores just to be online. After reading the press release, it just occured to me that cyberspace has also brought some changes in psyche of the human being. 

I think the validity of the results of the survey of women preferring the Internet over having sex is in keeping with the psyche of women in general.  It is not that exposure in cyberspace is more hormonally gratifying.

For single young women, self-respect and self-esteem occupy a higher attribute in their hierarchy of values, which is actually destroyed if they engaged in promiscuity even if the latter satisfies the libido beyond compare. The Internet provides young women with a viable  alternative to satisfy their ego, instead perhaps of just spending much time reading pocket books.  Young women are also more socially-inclined; constant and regular communication with relatives and friends, and meeting new ones,  are part of this behaviour.  Access to cyberspace tools like chatrooms and social networks provide a convenient medium.

For older women, Internet access could be a form of escapism from boredom, failed marriages, marital conflicts, for living in solitude, or when sex becomes a mere routine or obligation or no longer physically possible.   

Thus, while the survey was done with American women adults as respondents. Its validity could be global in perspective.  So men should better watch out because the Internet has come.

On the Call to Investigate Psychiatrists Testifying in Marital Dissolution Cases

Article 36 of the Family Code of the Philippines provides the legal remedy to spouses whose partner is psychologically incapacitated and unfit to comply with the essential marital obligations of marriage. The marriage may be declared null and void by the court.

Solicitor-General Agnes Devanadera expressed alarm over the apparent abuse of psychological incapacity as a ground for nullifying marriages. She said that although the Supreme Court has laid down the guidelines in the interpretation and application of psychological incapacity which must be characterized by juridical antecedence, gravity and incurability (and not mere “irreconciliable differences” or “conflicting personalities”), some Regional Trial Courts have been lenient in granting petitions for declaration of nullity of marriage on this ground.

The Solicitor-General noted that the number of annulment cases filed went up by over 58 percent in the span of just seven years. In 2001, only about 4,520 cases for annulment were filed while last year, it reached a peak of 7,753 cases. The year 2006 saw 7,138 annulment cases filed, while 2003 had 6,848 cases.

The role of the psychiatrist (or even psychologist) in marital nullity cases grounded on psychological incapacity has assumed significant importance when the Supreme Court ruled En Banc in the 13 February 2007 case of Republic vs. Molina that “(S)uch incapacity must also be shown to be medically or clinically permanent or incurable“.

Representative Roilo Golez of Paranaque City for his part is seeking the investigation of psychiatrists who may have violated their professional ethics for allowing their professions to be used in justifying annulment cases in exchange for some pecuniary benefits.

I think this is uncalled for, unless the good congressman can show proof of such anomalous practices. Mere generalization is not enough and would not do justice to the professions of psychiatry and psychology.

I also think that if there is any defect, it is in the law and not on the part of the psychiatrists or psychologists who are merely performing their vocation. In an earlier entry, I pointed out the anomaly of allowing those declared judicially as psychologically unfit to perform their marital duties and obligations to remarry, without the benefit of a clinical or medical clearance of subsequent treatment. Obviously, remarrying will never cure this incapacity. This is the loophole in the law, particularly Article 36 of the Family Code which our good legislators should address.

2009 CC Asia-Pacific Conference in Manila

Interview Techniques - Child Abuse Victims

Forensic interviews in child sexual abuse cases require a careful handling and strategy to influence disclosure, protect the victim and eventually ensure the prosecution of the offenders.

Recent studies have examined new directions in forensic interviews. In an article made available on line by the University of Nebraska entitled: Forensic interviewing in child sexual abuse cases: Current techniques and future directions, co-authors Lindsay E. Cronch, Jodi L. Viljoen, and David J. Hansen highlighted some interview techniques like allegation blind interviews, open-ended questioning, cognitive interviewing, the Touch Survey, truth–lie discussions, and anatomical dolls, among others.

Marital Fitness of Spouses Legally Declared Psychologically Incapacitated

If the guilty spouse is judicially declared psychologically incapacitated so as to render the marriage null and void, how come he or she is still allowed by law to re-marry? Obviously, if the degree of mental unfitness required by law is serious and incurable, the same cannot be remedied by having another lovelife. For this, they should be disqualified to remarry as a social deterrent for a continuing breakdown in the family as a social institution, or at least there must be a legal system to re-qualify them into entering another marital life. After all, the judicial determination should be binding before the whole world, in legal parlance.
